Terms of Use

1. Acceptance of these Terms

By accessing or using the Earth Signals website, maps, APIs, alerts, community features, or any related service (collectively, the “Service”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Service.

These Terms form an agreement between you and the operator of Earth Signals (“we”, “us”, or “Earth Signals”). Related policies include our Privacy Policy and Data & Alert Disclaimer, which are incorporated by reference.

2. No guarantee of accuracy

The Service aggregates and displays information from third-party sources. Information on the Service may be delayed, incomplete, inaccurate, outdated, or unavailable at any time.

• We do not warrant that any wildfire, storm, earthquake, tsunami, ocean, weather, closure, or other event is correctly detected, located, sized, timed, classified, or described.
• Map markers, timelines, status labels, sizes, polygons, and narrative summaries are approximate and may lag agency systems of record.
• Absence of an event on Earth Signals does not mean the hazard does not exist.

3. Not an emergency service

Earth Signals is provided for situational awareness and informational purposes only. It is not a substitute for:

• official emergency alerts (including wireless emergency alerts and provincial/state notification systems);
• emergency management agencies, fire services, meteorological services, or coast guards;
• professional advice (legal, medical, aviation, marine, engineering, or otherwise).

You should always follow official authorities and local emergency instructions. In an emergency, contact local emergency services immediately.

4. No life-safety reliance

You must not rely solely on the Service for decisions involving life safety, evacuation, emergency response, aviation, marine navigation, industrial operations, critical infrastructure, or other high-risk activities.

Any decision you make based on information from the Service is at your own risk. You are solely responsible for verifying conditions with official sources before acting.

5. Third-party data

Earth Signals aggregates information from government agencies and other providers (for example wildfire agencies, meteorological services, seismic networks, ocean observation networks, and satellite programs). We do not control those sources.

• If a source is wrong, delayed, revised, or offline, the Service may also be wrong, delayed, revised, or offline.
• Third-party terms, licences, and attribution requirements continue to apply to their data.
• We may add, remove, or change data sources at any time without notice.

6. Alerts

SMS, email, push notifications, in-app notices, webhooks, and any other alerts or notifications offered through the Service are provided on a best-effort basis only.

• Alerts are not guaranteed to be created, sent, delivered, received, or timely.
• Delivery can fail due to carrier filtering, device settings, network outages, spam controls, configuration errors, or Service interruptions.
• You remain responsible for monitoring official emergency and hazard sources independently of Earth Signals.

7. No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, UPTIME, AND AVAILABILITY.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that defects will be corrected.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EARTH SIGNALS AND ITS OPERATORS, AFFILIATES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY:

• property damage;
• business interruption;
• financial loss;
• personal injury;
• loss of life;
• lost profits, revenue, data, or goodwill; or
• indirect, incidental, special, consequential, exemplary, or punitive damages,

arising out of or related to your use of (or inability to use) the Service, reliance on any content or alert, or any third-party data — whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.

To the extent any liability cannot be excluded, our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) CAD $100.

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• scrape, harvest, or bulk-download content in a manner that violates these Terms, our robots rules, rate limits, or published API policies;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, accounts, or related systems;
• reverse engineer the Service where prohibited by law, except to the limited extent such restriction is not permitted;
• misrepresent the Service as an official emergency system or remove required attribution;
• use automated means to create accounts, send spam, or abuse alerts or community features.

We may suspend or terminate access for violations or to protect the Service or other users.

10. Paid subscriptions

Billing

If you purchase a paid plan, you authorize us (and our payment processors) to charge the applicable fees and taxes on the billing schedule presented at checkout. Prices may change with notice as described at purchase or in-product.

Renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before renewal according to the cancellation method provided in your account or billing portal.

Cancellation

You may cancel a subscription at any time. Cancellation generally takes effect at the end of the then-current paid period unless otherwise stated at purchase. Access to paid features may continue until that period ends.

Refunds

Fees are non-refundable except where required by law or where we expressly state otherwise at the time of purchase. If a billing error occurs, contact us at [email protected] and we will review it in good faith.

11. Changes to the Service and Terms

We may modify features, data sources, APIs, pricing, branding, and these Terms at any time. Material changes to the Terms will be indicated by updating the effective date on this page and, where appropriate, additional notice. Continued use after changes become effective constitutes acceptance of the updated Terms.

12. Intellectual property

• The Earth Signals software, site design, trademarks, and original content remain our property (or our licensors’), subject to these Terms.
• Government and other third-party datasets remain subject to their own licences, terms, and attribution requirements.
• Third-party names and trademarks belong to their respective owners and do not imply endorsement.

13. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts located in British Columbia, Canada will have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any non-waivable consumer protections that apply in your place of residence.

14. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale of assets.
