Earth Signals is an informational environmental monitoring platform. It is not an official emergency alert system. Always follow directions from official authorities.

1. Acceptance of these Terms

By accessing or using the Earth Signals website, maps, APIs, alerts, community features, or any related service (collectively, the “Service”), you agree to these Terms of Use (the “Terms”). If you do not agree, do not use the Service.

These Terms form an agreement between you and the operator of Earth Signals (“we”, “us”, or “Earth Signals”). Related policies include our Privacy Policy and Data & Alert Disclaimer, which are incorporated by reference.

2. No guarantee of accuracy

The Service aggregates and displays information from third-party sources. Information on the Service may be delayed, incomplete, inaccurate, outdated, or unavailable at any time.

Earth Signals is provided for situational awareness and informational purposes only. It is not a substitute for:

4. No life-safety reliance

You must not rely solely on the Service for decisions involving life safety, evacuation, emergency response, aviation, marine navigation, industrial operations, critical infrastructure, or other high-risk activities.

Any decision you make based on information from the Service is at your own risk. You are solely responsible for verifying conditions with official sources before acting.

5. Third-party data

Earth Signals aggregates information from government agencies and other providers (for example wildfire agencies, meteorological services, seismic networks, ocean observation networks, and satellite programs). We do not control those sources.

6. Alerts

SMS, email, push notifications, in-app notices, webhooks, and any other alerts or notifications offered through the Service are provided on a best-effort basis only.

7. No warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, UPTIME, AND AVAILABILITY.

We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that defects will be corrected.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EARTH SIGNALS AND ITS OPERATORS, AFFILIATES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY:

arising out of or related to your use of (or inability to use) the Service, reliance on any content or alert, or any third-party data โ€” whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if advised of the possibility of such damages.

To the extent any liability cannot be excluded, our aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) CAD $100.

Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

10. Paid subscriptions

Billing

If you purchase a paid plan, you authorize us (and our payment processors) to charge the applicable fees and taxes on the billing schedule presented at checkout. Prices may change with notice as described at purchase or in-product.

Renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before renewal according to the cancellation method provided in your account or billing portal.

Cancellation

You may cancel a subscription at any time. Cancellation generally takes effect at the end of the then-current paid period unless otherwise stated at purchase. Access to paid features may continue until that period ends.

Refunds

Fees are non-refundable except where required by law or where we expressly state otherwise at the time of purchase. If a billing error occurs, contact us at [email protected] and we will review it in good faith.

11. Changes to the Service and Terms

We may modify features, data sources, APIs, pricing, branding, and these Terms at any time. Material changes to the Terms will be indicated by updating the effective date on this page and, where appropriate, additional notice. Continued use after changes become effective constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Courts located in British Columbia, Canada will have exclusive jurisdiction over disputes arising from these Terms or the Service, subject to any non-waivable consumer protections that apply in your place of residence.

14. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale of assets.
